The rule of law
The most over-used buzz phrase in Europe

It is not a good proposition for European politicians, and especially Hungarian politicians, to assert that they uphold the rule of law when it is evident to just about everyone, that they do not. Politics today is dominated by the political party whose prime interests are bent on power and money and who see the law as a convenient mechanism for ruling others. They do not uphold any rule of law which subjects them, on an equal basis to all others, to the law.

It is also obvious that politicians themselves do not hold the law in high esteem and indeed are quite cynical about legal process. They talk about freedom, democracy and the rule of law during elections but in practice work against the establishment of genuine equality of all before the law. Part of the reason for this is their intimate knolwledge of the motivations of the judiciary and the degree to which they can influence this. In many countries judges are political party appointees and therefore, like politicians, are not to be trusted.

So political parties, and especially their senior members, feel pretty immune from the law as well as being able to get off with breaking the law and not be subjected to legal process.

Hungarian politicians grew up in the Soviet system where party members were almost completely immune from any legal sanction. This is why when the Soviet regime collapsed one did not see any enhancement of the rule of law. In its place one saw a more cynical use of law to control people and events. In the context of Romani World interests, the Roma, the most outstanding example has been the changing of the law to provide local authorities with direct financial incentives to force rural Roma children into segreated educational denial. This policy has been a "success" in achieving a complete segregation of the Roma children and transferring to party aperatiks in local authorities over Euro 1.25 billion since 1989.

The rule of law?

Everyone knows that this is no rule of law and in particular European Law. Everyone knows that the Hungarian government did not fully expose the truth to the European Commission on this tyranny. On the other hand, the European Commission when warned about this in 1999 and then provided with evidence in 2003, prevaricated. The European Commission the central institution which fools the European public into thinking it is the Guardian of the European Treaties, simply did not act. The European Commission therefore also contravened European Law. Its irresponsibility is an affront to the Roma in Central Europe and a demonsration of the complete dishonesty of promoting its jealously-guarded mandate on behalf of citizens of Europe, but which does not have the ethics nor morality to exercise in practice.

So much for the rule of law in Europe.
